This website is operated by TempoTec. Throughout the site, the terms “we”, “us” and “our” refer to TempoTec. By visiting our site and/or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”).

Please read these Terms of Service carefully before accessing or using our website.

SECTION 1 - ONLINE STORE TERMS

By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state or province of residence. You may not use our products for any illegal or unauthorized purpose, nor may you, in the use of the Service, violate any laws in your jurisdiction.

SECTION 2 - ACCURACY OF BILLING AND ACCOUNT INFORMATION

We reserve the right to refuse any order you place with us.

• Regional Requirements: For shipments to Taiwan, you are required to provide a valid ID number and complete EZ WAY authentication. For Brazil/Chile, a valid CPF/RUT is mandatory.
• Consequences: If you provide inaccurate or incomplete information, we reserve the right to cancel your order or withhold shipment without liability for delays.

SECTION 3 - PRODUCTS AND TECHNICAL MODIFICATIONS (FIRMWARE POLICY)

We take pride in our Hi-Fi audio engineering. However, the user assumes all risks associated with technical modifications.

• Firmware Integrity: Official firmware updates must only be applied to the specific model they are intended for (e.g., M5 firmware must NOT be flashed onto an M3 device).
• Unauthorized Tampering: Any attempt to flash incorrect, third-party, or modified firmware, or any unauthorized dismantling of the device, constitutes a breach of these Terms and will void all warranties immediately. TempoTec is not liable for "bricked" devices resulting from user-induced technical errors.

SECTION 4 - MODIFICATIONS TO THE SERVICE AND PRICES

Prices for our products are subject to change without notice. We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice at any time.

SECTION 5 - SHIPPING AND CUSTOMS COMPLIANCE

All international orders are shipped DDU (Delivered Duty Unpaid) unless specified otherwise (e.g., IOSS for EU <€150).

• Duty Responsibility: The buyer is responsible for all import duties, taxes, and customs fees.
• Refusal Policy: If a package is abandoned or destroyed by the carrier because the buyer refuses to pay customs duties or provides incorrect identification, TempoTec will not issue a refund. Original and return shipping costs will be deducted from any potential partial credit at our sole discretion.

SECTION 6 - THIRD-PARTY LINKS

Certain content, products, and services available via our Service may include materials from third-parties (e.g., YunExpress, SF Express, Yanwen). We are not responsible for examining or evaluating the content or accuracy and we do not warrant and will not have any liability or responsibility for any third-party materials or websites.

SECTION 7 - USER COMMENTS, FEEDBACK AND OTHER SUBMISSIONS

If you post reviews or technical feedback on our Audio Resource Center, you grant us a non-exclusive license to use, edit, and publish that content. We reserve the right to remove content that we determine in our sole discretion is unlawful, offensive, or violates any party’s intellectual property.

SECTION 8 - ERRORS, INACCURACIES AND OMISSIONS

Occasionally there may be information on our site that contains typographical errors, inaccuracies or omissions that may relate to product descriptions, pricing, promotions, offers, product shipping charges, transit times and availability. We reserve the right to correct any errors and to change or update information or cancel orders if any information is inaccurate at any time without prior notice.

SECTION 9 - LIMITATION OF LIABILITY

In no case shall TempoTec , our directors, officers, employees, or affiliates be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, or consequential damages of any kind, including, without limitation lost profits, lost revenue, or damage to source devices (Phones/PCs) arising from your use of any of our products.

SECTION 10 - GOVERNING LAW

These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of Dongguan, Guangdong, China.
